Applicable privacy legislation
Because Conceptfabriek is established in Belgium, our processing is governed by the EU General Data Protection Regulation, applicable Belgian data-protection legislation and Belgian electronic-communications rules.
For users in India, we also apply the provisions of Indian data-protection and information-technology law that are applicable to our activities, including, during the applicable transition period, Section 43A of the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

Where information concerning disability, health, workplace accommodation or another sensitive matter is genuinely necessary for an application, it should preferably be communicated directly to the relevant employer through an appropriate private channel.
Under the GDPR, certain information may qualify as a special category of personal data. We will process such information only where a specific legal condition applies, such as explicit consent, employment-law requirements or the establishment, exercise or defence of legal claims.
Under applicable Indian law, certain information may qualify as sensitive personal data or information. Where legally required, we will request specific consent before collecting or disclosing such information.
Engineerjob.in may remove unnecessary sensitive data from a profile or document where reasonably possible, but we are not required to review every document before it is uploaded or transmitted.
Sources of personal data
We primarily obtain personal data directly from you when you create an account, upload a CV, apply for a vacancy, publish a vacancy, purchase a package, complete a form, contact us or use the website.

public professional sources where collection and reuse are lawful;

fraud-prevention, cybersecurity or identity-verification providers;
competent authorities or professional advisers.
If you provide personal data relating to another person, you confirm that you are authorised to provide it and, where required, have informed that person about the processing.

to make candidate profiles available to authorised employers in accordance with the candidate’s selected visibility settings;
to transmit applications and candidate information to the employer selected by the candidate;
to provide job alerts, profile alerts, recommendations and search results;
to classify vacancies and profiles by engineering discipline, location, function, experience and other relevant criteria;
to process orders, payments, invoicing, refunds and account credits;
to provide customer support and respond to questions, complaints and privacy requests;
to distribute and promote vacancies through Engineerjob.in, search engines, social media, advertising platforms, job feeds, newsletters and other websites in the Conceptfabriek network;
to communicate operational information about accounts, applications, vacancies, payments, security or service changes;
to send newsletters, commercial offers or promotional communications where permitted by law;
to measure website performance and understand how users interact with the platform;
to improve the relevance, usability, accessibility, security and commercial performance of the services;
to detect and prevent fraud, fake vacancies, impersonation, unauthorised access, scraping, abuse and other unlawful conduct;
to enforce our Terms of Use and protect candidates, employers, Conceptfabriek and third parties;
to create aggregated or anonymised statistics that no longer identify an individual;
to comply with accounting, taxation, regulatory, judicial and other legal obligations;
to establish, exercise or defend legal claims;
to facilitate a merger, acquisition, restructuring, financing, asset transfer or sale of all or part of the platform or business.
Legal grounds under the GDPR
Where the GDPR applies, we rely on one or more of the following legal grounds:
Performance of a contract or pre-contractual measures: for creating and operating an account, transmitting an application, publishing a vacancy, processing an order or providing a requested service;
Legitimate interests: for operating and improving the platform, protecting our systems, preventing fraud, enforcing our rights, conducting limited business analytics and communicating with existing professional customers, provided that those interests are not overridden by the user’s rights and freedoms;
Consent: for optional candidate-profile visibility, non-essential cookies, certain marketing communications, sensitive information and other processing for which consent is legally required;
Legal obligations: for taxation, accounting, regulatory reporting, lawful authority requests and other mandatory requirements;

Where processing is based on consent, you may withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.

Grounds under Indian data-protection law
Where Indian data-protection legislation applies, we process personal data on the basis of valid consent, a lawful purpose, a permitted legitimate use or another ground recognised under applicable Indian law.
When the relevant provisions of the Digital Personal Data Protection Act become applicable, notices and consent requests will identify the personal data and specified purpose in clear and plain language and will provide an accessible method to withdraw consent and submit a grievance.
The service will not be made conditional on personal data that is unnecessary for the requested function, except where the information is reasonably required to operate, secure or comply with legal obligations relating to that function.
Candidate profiles and CV database
Where the CV-database function is available, registered job seekers may create or upload a candidate profile and indicate whether they wish to be contacted by employers.
A candidate can normally place a profile offline, modify its visibility or delete it through the candidate account. Certain information may remain in restricted backups, security records or legally required archives for a limited period.
The visibility of a candidate profile depends on the settings selected and the services available at the relevant time.
Unregistered visitors are not intended to receive direct access to candidate contact details. Registered employers may receive a limited or anonymised profile summary. Identifying or contact information may be restricted to authenticated or paying employers with the relevant access rights.
Payment by an employer is for access to platform functionality and does not transfer ownership of candidate data to that employer.
Employers may access candidate information only for genuine recruitment purposes and are contractually prohibited from selling it, using it for unrelated marketing, creating an unauthorised external database or sharing it with unauthorised parties.
A candidate who activates profile visibility expressly requests that Engineerjob.in disclose the selected profile information to employers falling within the chosen visibility settings.
Where candidate information may be accessed from a country outside the European Economic Area, the profile settings and notice should provide sufficient information about that international disclosure. Additional consent or contractual safeguards may be requested where required.
Candidates remain responsible for the accuracy and lawfulness of the content they upload. Conceptfabriek does not verify every degree, qualification, employment history, reference, licence, work permit or professional statement appearing in a candidate profile.
Applications to employers
When you apply for a vacancy, we transmit the information you choose to provide to the employer, recruiter or application system identified in the vacancy.
After an employer receives an application, that employer will generally process the application as an independent controller or Data Fiduciary under its own privacy obligations.
Engineerjob.in does not control how an independent employer evaluates, retains, shares or deletes an application after receiving it. Candidates should review the employer’s privacy information before submitting sensitive or extensive personal data.
Where an application is redirected to an external recruitment website, applicant-tracking system or employer website, the privacy policy of that external service will apply to the information collected there.
Conceptfabriek may retain evidence that an application was sent, including the vacancy identifier, candidate account, employer, date and technical delivery status, for security, service administration and dispute-resolution purposes.
Automated matching, ranking and recommendations
Engineerjob.in may use automated tools to classify, search, rank or recommend vacancies and candidate profiles based on information such as keywords, engineering discipline, experience, location, education and selected preferences.
These tools are intended to improve relevance and do not make the final decision to interview, reject, engage or employ a candidate.
Employers remain fully responsible for their recruitment decisions. Engineerjob.in does not make legally binding employment decisions on behalf of an employer.
Where applicable law grants a right concerning a decision based solely on automated processing that produces legal or similarly significant effects, users may contact us to request relevant information or human review.
Job alerts and service communications
Users may request job alerts or similar notifications based on selected disciplines, keywords, locations or other preferences.
Job alerts requested by a user are part of the requested service and can be disabled through the account, alert settings or unsubscribe link.
We may send essential service messages without separate marketing consent. These may concern account security, password changes, applications, vacancy publication, orders, invoices, legal notices or material platform changes.
Marketing communications
We may send newsletters, offers, surveys or promotional communications where you have consented or where another legal ground permits such communication.
Creating an account does not automatically mean that a candidate has consented to unrelated marketing.
Every electronic marketing message will provide an appropriate unsubscribe method. Unsubscribing from marketing does not prevent essential account or transaction messages.
We may retain limited suppression information after an unsubscribe request to ensure that the address is not added again to the same marketing list.

Payments may be processed by an external payment-service provider. Full payment-card information is normally entered directly into the payment provider’s secure environment and is not intended to be stored by Engineerjob.in.
We may receive transaction identifiers, payment status, payment method, billing name, billing address, tax details, amount, currency and fraud-prevention results.
The payment provider may act as an independent controller for certain payment, compliance, fraud-prevention and regulatory activities.
Sharing with employers and recruiters
Candidate data may be shared with an employer or recruiter when:
the candidate applies for that employer’s vacancy;
the candidate activates an employer-visible profile;
the candidate expressly requests or authorises the disclosure;
the sharing is otherwise necessary to provide a requested recruitment service.
Employers and recruiters must process candidate data lawfully, securely and only for genuine recruitment purposes.
Conceptfabriek may investigate complaints about employer misuse, restrict an employer’s access or require deletion, but cannot guarantee that every independent recipient will comply with its obligations.
Nothing in this Privacy Policy excludes Conceptfabriek’s own statutory responsibilities for selecting recipients, implementing appropriate safeguards or responding to known misuse.
International Conceptfabriek network
Conceptfabriek operates an international network of specialised job platforms. Vacancy and employer information may be distributed or promoted through other websites in this network where this is part of the purchased service, relevant to the vacancy or permitted under our Terms of Use.
Candidate personal data will not automatically be published throughout the full network merely because a candidate creates an account on Engineerjob.in.
Candidate information may be made available through another network platform only where this is consistent with the candidate’s settings, requested service, consent and applicable law.
Other disclosures
We may disclose personal data:
where required by a binding legal obligation, court order or lawful authority request;
to investigate or prevent fraud, cybercrime, impersonation, threats, abuse or other unlawful conduct;
where necessary to protect the rights, safety or property of users, Conceptfabriek or another person;
to establish, exercise or defend a legal claim;

Conceptfabriek does not sell ownership of candidate CVs or candidate contact details as a standalone data product.
Employers may pay for controlled access to recruitment functionality, including access to employer-visible profiles. Such payment is for access to the platform service and does not give the employer unrestricted ownership or reuse rights.
Advertising and analytics providers may receive identifiers or usage information as explained in this Privacy Policy and the Cookie Policy. These disclosures are subject to the applicable consent and data-protection requirements.
Public information and search engines
Information deliberately placed in a public section of Engineerjob.in may be accessible to internet users and may be indexed, cached, archived or copied by search engines and other third parties.
Vacancies are normally intended to be indexed by authorised search engines and job-search services.
Candidate profiles are not intended to be indexed by general search engines unless the relevant feature and visibility setting expressly provide otherwise.
Where a candidate profile is configured as non-public, Engineerjob.in may use technical instructions such as “noindex” and access restrictions. No technical measure can guarantee that an external party will never cache, copy or retain information.
If publicly accessible information is removed from Engineerjob.in, copies may temporarily remain in search-engine caches, browser histories, archives, recipient systems or third-party records outside our direct control.
We will take reasonable action concerning information under our control but cannot guarantee immediate deletion from every independent third-party system.
Unauthorised crawling and extraction

Such information may be retained and disclosed to hosting providers, security providers, professional advisers or competent authorities where reasonably necessary to protect the platform and its users.
International data transfers
Engineerjob.in serves users in India while Conceptfabriek is established in Belgium. Personal data may therefore be processed in Belgium, the European Economic Area, India, the United States and other countries in which our service providers, employers or authorised recipients operate.
When personal data protected by the GDPR is transferred outside the European Economic Area, we will use an available lawful transfer mechanism where required, such as:
an adequacy decision adopted by the European Commission;
the European Commission’s Standard Contractual Clauses;
another approved contractual or organisational safeguard;
a transfer necessary for a contract or pre-contractual steps requested by the data subject;

Employer access to candidate information from outside the European Economic Area may constitute an international transfer. Authorised employers may therefore be required to accept additional data-protection and international-transfer conditions.
Where Indian law restricts transfers to a particular country, territory, foreign state or entity, Engineerjob.in will comply with the applicable restriction from the date on which it becomes legally effective.
Security
Conceptfabriek applies technical and organisational measures designed to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure, unauthorised access and other unlawful processing.
Depending on the nature and risk of the processing, measures may include:
encrypted connections using HTTPS;
password hashing and secure authentication controls;
role-based access restrictions;
multi-factor authentication for selected administrative functions;
firewalls, anti-abuse tools and security monitoring;
logging and review of access and security events;
software maintenance, updates and vulnerability management;
backups and continuity measures;
processor contracts containing security and confidentiality obligations;

Security measures are reviewed in light of the nature, scope, context and purpose of the processing, the state of technology, implementation costs and the risks to individuals.
No internet service, database, email message or transmission method is completely secure. Conceptfabriek cannot guarantee that a security incident will never occur.
This limitation does not exclude any security obligation or liability that cannot validly be excluded under applicable law.
Users are responsible for choosing a strong and unique password, protecting login credentials, logging out on shared devices and notifying us promptly of suspected unauthorised account access.
Personal-data breaches
Conceptfabriek maintains procedures for assessing and responding to suspected personal-data breaches.
Where the GDPR applies, we will notify the competent supervisory authority and affected persons where and within the period required by the GDPR.
Where applicable Indian law requires notification to the Data Protection Board of India, affected Data Principals or another authority, we will provide the required information in the prescribed form and within the applicable period.
A breach notification may describe the nature and extent of the incident, likely consequences, mitigation measures, recommended safety steps and contact details for further questions.
Retention
We retain personal data only for as long as reasonably necessary for the relevant purpose, legal obligations, security, fraud prevention, accounting, dispute resolution and the establishment, exercise or defence of claims.
Retention depends on factors including:
whether an account or profile remains active;
the user’s selected profile and communication settings;
the duration of an employer package or vacancy publication;
the existence of an application, order, payment or customer relationship;
statutory accounting, taxation and record-keeping requirements;
security, fraud and abuse-prevention requirements;
applicable limitation periods and pending disputes;
mandatory retention or erasure periods under Indian or European law.
Candidate profiles will normally be retained while the profile remains active or while the candidate continues to use the service. Candidates can place a profile offline or request deletion.
Inactive accounts may be deleted, anonymised or restricted after an appropriate inactivity period. Where legally required, the user will receive advance notice before automatic erasure.
Vacancy and employer-account information may be retained after publication ends for customer administration, invoicing, fraud prevention, evidence and repeat-publication functionality.
Invoices, payment records and related business documents will be retained for the applicable statutory accounting and taxation periods.
Security records and logs may be retained for the period reasonably necessary to detect, investigate and prevent unauthorised access and to comply with applicable legal requirements.
Backups are maintained on a rolling basis and may contain information that has been removed from active systems. Backup data is protected, not ordinarily restored for normal use and deleted or overwritten according to the applicable backup cycle.
Information may be retained for longer where necessary for an investigation, legal hold, pending complaint, legal claim or binding authority request.
Once retention is no longer justified, information will be deleted, anonymised or otherwise placed beyond normal operational use.
Your rights
